Terms of Service

put.sh is an online, subscription-based, deployment management service (hereinafter “put.sh”, “we” or “us”). These terms of service govern your use of the put.sh software and any additional services offered by or available from PUT LLP (the “services”). Please read these terms of service carefully.

Your accessing of this web site and use of the services signifies that you (“you” or the “user”) agree to the following terms of service and you consent to the following terms of service (“terms of service”) disclosed herein. You and put.sh intend that this is a binding legal agreement. If you do not agree with any or all of these terms, do not use the services. Violation of these terms of service will result in the termination of your access to the services.

put.sh is a service operated by PUT LLP, a UK registered partnership (OC397530). Registered at 57 Queen Charlotte Street, Bristol, BS1 4HQ.

Changes to the Terms of Service

We may change these terms of service at any time. You can review the most current version of these terms by clicking on the “terms of service” link located in the footer of our website. You are responsible for checking these terms periodically for changes. If you continue to use the services after we post changes to these terms of service, you are signifying your acceptance of the new terms.

General Terms

  • You must be 13 years or older in order to use the services.
  • One person or legal entity may not maintain more than one free account.
  • Your login may be used by you only. You may not share your log in with anyone else.
  • You must provide your full legal name, a valid email address and other information we request in order to complete the signup process.
  • You are responsible for maintaining the security of your account and password. put.sh accepts no responsibility or liability for any loss or damage arising from your failure to comply with this security obligation.
  • You are responsible for ensuring you account information is up-to-date at all times.
  • You are also responsible for all of the content posted and activity that occurs under your account.
  • The service is provided on a strictly “as is” and “as available” basis.
  • You may use the put.sh services for lawful, authorised purposes and only in accordance with these terms of service.
  • We reserve the right to remove any information which we consider to be unlawful, offensive, threatening, libellous, defamatory, pornographic or otherwise objectionable, or which violates the intellectual property of a third party.
  • These terms or service shall be governed by and construed in accordance with English law. Both parties agree that the courts of England are to have non-exclusive jurisdiction to settle any disputes which may arise in connection with the terms or service.

The put.sh website, interface, system and content therein is copyright © PUT LLP. All Rights Reserved.

You may not modify, adapt, copy or create derivative works based on the put.sh services, or reverse engineer, decompile or disassemble the put.sh services.

We claim no intellectual property rights over the material you provide to the service. Your account profile and the materials you upload are yours. We do not pre-screen any content, however, we retain the right, but not the obligation, in our sole discretion, to refuse or remove any content that violates this terms of service agreement.

Pricing & Payments

Subject to any amendment to this agreement, the service is available in a ‘free’ and in several ‘paid’ versions. The prices and payment of the paid versions are based on the current price list which can be viewed at http://put.sh

We will attempt to debit the credit/debit card you have on your account. Payments will be taken at the beginning of the each billable period. Where payment fails – we will notify you by email.

put.sh has the right to change prices and terms of payment for the service from time to time. put.sh will inform you about changes in prices or terms of payment via the website. The change in prices and payment will be made, however, at the expiry of the actual agreed contract period. Your continued use of the service after such knowledge is taken as acceptance of those changes.

Unless otherwise agreed, all prices are in Pounds, US Dollars or Euros. Upon termination, all outstanding claims will become immediately due and – if this applies to you – will be collected via your account agreed recovery method.

Customers from within the UK & EU are subject to UK VAT – charged at 20%. Customers outside the UK & EU will incur no additional charges. Any US & EU prices displayed are based on the current exchange rate. VAT will be added to all applicable invoices.

Invoicing

Invoices will be sent to the email address associated with you Account and can also be viewed and downloaded via your Account. When an invoice is sent out we will attempt to debit the credit or debit card. If a payment fails you will be notified by email. Your Account will be suspended if payment is not made within five days of the renewal date.

Automatic Renewals

Unless you have cancelled or downgraded to a Free Account your subscription will automatically renewed on an ongoing basis. You authorise us to collect the currently-applicable monthly (including VAT where applicable) using any credit/debit card, or any other payment solution associated with your Account.

Refund Policy

  • All payments are non-refundable.
  • No refunds will be made for account downgrades or unused resource.
  • Cancellations at any stage will not be refunded.
  • Only charges made in error will credit be refunded your Account.

Upgrading or Downgrading of your Account

Upgrading – You can upgrade your Account at anytime. You will be charged the new amount from your next renewal date however the new resource levels will be made available immediately.

Downgrading* – You can downgrade your Account at anytime, however, if your current Account is using a higher resource than the lower package allows you will be required to adjust your resource accordingly before the downgrade can be applied.

*Downgrading your service may cause the loss of content, features, or capacity of your account. put.sh does not accept any liability for such loss.

For security reasons any changes made to an Account will be recorded.

Cancellation

You can cancel your Account at any time. To process a cancellation log in to your Account, select ‘My Account’ followed by ‘Cancel My Account’. Once cancelled all data will be removed from our systems immediately and you will not be charged again. Please be aware that for security reasons we are unable to accept cancellation requests by phone or e-mail.

Accounts will be suspended if payment is not made within two days of account’s renewal date. Accounts may be cancelled and all data removed from our systems if payment has not been received within of 90 days of account expiry.

Once your account has been cancelled you will not be charged again.

The minimum term for this agreement is one (1) month. If you do not cancel your subscription with the service, the term will automatically be extended by the minimum term. Your right to use put.sh automatically terminates at the end of the term of our agreement and earlier if you violate these terms of service in connection with your use of put.sh. We reserve the right, in our sole discretion, to terminate your access to all or part of put.sh, in the event of you breach these terms of service, with or without notice.

You are solely responsible for properly cancelling your account. You can cancel your account at any time via the put.sh Dashboard.

All of your content will be immediately deleted from the services upon cancellation. This information can not be recovered once your account is cancelled. If you cancel the services before the end of your current paid up month, your cancellation will take effect immediately and you will not be charged again. put.sh, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the services, or any other put.sh service, for any reason at any time. Such termination of the services will result in the deactivation or deletion of your account or your access to your account, and the forfeiture and relinquishment of all content in your account. put.sh reserves the right to refuse service or the services to anyone for any reason at any time.

Account Suspension

If payment is not received within five days of your renewal date your Account will be suspended. If the payment is not received within 30 days or your renewal date your Account will be cancelled and all data will be removed from our system immediately.

Chargeback Policy

If a chargeback is issued against any payments taken by us the associated Account will be cancelled immediately.

Privacy Policy

The put.sh privacy policy explains the practices that apply to your information when you use the put.sh services. Your ongoing use of the put.sh services signifies your consent to the information practices disclosed in our privacy policy. You can review the privacy policy by clicking on the “privacy policy” link located in the footer of our website.

Changes to put.sh

We may discontinue or modify any service or feature of put.sh at any time, provided we provide you with not less than fourteen (14) days prior notice.

Acceptable Use

Excessive Bandwidth Usage

Bandwidth Usage on all put.sh accounts will be monitored on a monthly basis. put.sh maintains an excessive use policy to address data consumption by users of the service that is wholly uncharacteristic of a typical user on the same package (as determined by put.sh in its sole discretion). If you exceed this limit, you will be notified by e-mail and we will work with you to resolve the situation to ensure it is not repeated.

Viruses

The uploading of viruses to, or via our service is forbidden and will result in the file(s) being removed immediately. It may also result in the termination of the offending account. Where infected files have been uploaded unintentionally we will do our best to assist our users in rectifying the situation.

Disclaimer of Warranties

We provide put.sh “as is” and “as available” and you use the put.sh service at your own risk. We make no express warranties or guarantees about put.sh. To the extent permitted by law, we and our licensors disclaim implied warranties that put.sh and all software, content and services distributed through put.sh are merchantable, of satisfactory quality, accurate, timely, fit for a particular purpose or need, or non-infringing. We do not guarantee that put.sh will meet your requirements, is error-free, bug-free, reliable, without interruption or available at all times. We do not guarantee that the results that may be obtained from the use of put.sh, including any support services, will be effective, reliable, accurate or meet your requirements. We do not guarantee that you will be able to access or use put.sh (either directly or through third-party networks) at times or locations of your choosing. No oral or written information or advice given by put.sh representative shall create a warranty. You may have additional consumer rights under your local laws that this contract cannot change depending upon the jurisdiction in which the software is utilised.

Limitation of Liability

We shall not be liable for any indirect, special, incidental, consequential or exemplary damages arising from your use of, inability to use, or reliance upon put.sh. These exclusions apply to any claims for lost profits, lost data, loss of goodwill, work stoppage, computer failure or malfunction, or any other commercial damages or losses, even if we knew or should have known of the possibility of such damages. Because some provinces, states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such provinces, states or jurisdictions, our liability, and the liability of our parent and suppliers, shall be limited to the extent permitted by law.
